These terms govern your use of Ouch is Fabric (the "App"), an AAC-button messaging application provided by Spencer Poisseroux ("we", "us"). By installing or using the App you agree to these terms. If you don't agree, don't use the App.
The basics
- The App is provided as-is for personal use.
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App.
- You're responsible for the messages you send. Don't use the App to harass, threaten, defraud, or stalk anyone.
- Don't reverse-engineer or interfere with the App's operation, attempt to bypass quotas, or access accounts that aren't yours.
How identity works
The App generates a random 10-character friend code on your device when you first open it. Anyone you give that code to can send you messages. If you delete the App or your account, that code is permanently gone — there's no recovery flow today (account recovery via Sign in with Apple / Google is planned for a future version).
Messages
- Messages consist of tappable buttons (a fixed vocabulary set by us, expandable via paid packs).
- Our server is a relay only. Message content is not stored on our server after delivery. Sender and recipient devices retain a local history buffer of recent messages.
- Messages may be delayed or lost in flight if either device is offline. We don't guarantee delivery.
Daily quota
Free accounts can send a fixed number of messages per day (currently 15 across all conversations, resetting at UTC midnight). You can purchase top-up packs to send more.
Purchases
- Paid items (voice packs, button packs, top-ups) are sold via the Apple App Store or Google Play Store. Their terms apply to the purchase transaction.
- Purchases are tied to an anonymous install ID on your device. Entitlements survive account deletion on the same device (so deleting and re-creating your friend code doesn't destroy your paid content), but DO NOT survive uninstalling the App. Use the App Store / Play Store's "Restore Purchases" flow after a reinstall.
- Top-up packs are consumable. Once spent, they're gone.
- Subscriptions (if offered in a future version) auto-renew via the store. Cancel via your Apple ID or Google Play subscription settings.
- Refunds are handled through the App Store / Play Store, not directly by us.
Content rules
The App's vocabulary is curated. We reserve the right to modify the vocabulary, suspend an account that's been reported by 5 or more other users in 24 hours, and remove any account that abuses the App. If your account is suspended, you can appeal by emailing [email protected].
Privacy
Our Privacy Policy describes what data we collect and how we handle it.
No warranties
The App is provided "AS IS" without warranties of any kind. We don't guarantee the App will be uninterrupted, error-free, secure, or fit for any particular purpose. To the maximum extent permitted by law, Spencer Poisseroux is not liable for any indirect, incidental, or consequential damages arising from your use of the App.
Termination
You can stop using the App at any time. We can suspend or remove your access if you violate these terms or applicable law. On termination, the sections about purchases, no warranties, and liability survive.
Changes
If we update these terms materially, we'll update the "Last updated" date and surface a notice in the App on next launch. Continued use after the notice means acceptance.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of laws principles.

本規約は、Spencer Poisseroux（以下「当方」）が提供する AAC ボタン式メッセージアプリ「Ouch is Fabric」（以下「本アプリ」）の利用について定めるものです。本アプリをインストールまたは利用することにより、本規約に同意したものとみなされます。同意いただけない場合は、本アプリをご利用にならないでください。
基本事項
- 本アプリは、個人利用を目的として現状のまま提供されます。
- 本アプリのご利用には、13歳以上（またはお住まいの地域で定められた最低年齢以上）であることが必要です。
- 送信したメッセージについてはあなたが責任を負います。本アプリを使って他者を嫌がらせ、脅迫、詐欺、またはつきまとうことはおやめください。
- 本アプリのリバースエンジニアリングや動作の妨害、上限の回避の試み、自分以外のアカウントへのアクセスはおやめください。
本人確認のしくみ
本アプリは、初めて開いたときに端末上で10文字のランダムなフレンドコードを生成します。このコードを渡した相手は、あなたにメッセージを送れるようになります。アプリまたはアカウントを削除すると、そのコードは完全に失われます。現時点では復旧の手段はありません（Apple / Google でのサインインによるアカウント復旧は将来のバージョンで予定しています）。
メッセージ
- メッセージは、タップできるボタン（当方が定めた固定の語彙。有料パックで拡張可能）で構成されます。
- 当方のサーバーは中継のみを行います。メッセージの内容は配信後にサーバーへ保存されません。送信者と受信者の端末には、最近のメッセージのローカル履歴が保持されます。
- いずれかの端末がオフラインの場合、メッセージが遅延したり、配信途中で失われたりすることがあります。配信を保証するものではありません。
1日の上限
無料アカウントは、1日あたり一定数のメッセージを送信できます（現在はすべての会話を合わせて15件で、UTCの深夜0時にリセットされます）。追加で送信するには、チャージパックを購入できます。
購入
- 有料アイテム（ボイスパック、ボタンパック、チャージ）は、Apple App Store または Google Play ストアを通じて販売されます。購入取引にはそれぞれのストアの規約が適用されます。
- 購入は、端末上の匿名のインストールIDに紐付けられます。利用権は同じ端末でのアカウント削除後も維持されます（フレンドコードを削除して作り直しても、有料コンテンツは失われません）が、本アプリのアンインストール後は維持されません。再インストール後は、App Store / Play ストアの「購入の復元」をご利用ください。
- チャージパックは消費型です。使い切ると元には戻りません。
- サブスクリプション（将来のバージョンで提供される場合）は、ストアを通じて自動更新されます。解約は Apple ID または Google Play のサブスクリプション設定から行ってください。
- 返金は当方ではなく、App Store / Play ストアを通じて処理されます。
コンテンツに関するルール
本アプリの語彙は当方が管理しています。当方は、語彙を変更する権利、24時間以内に5名以上の他のユーザーから報告されたアカウントを停止する権利、および本アプリを濫用するアカウントを削除する権利を留保します。アカウントが停止された場合は、[email protected] までメールで異議を申し立てることができます。
プライバシー
当方のプライバシーポリシーに、収集するデータとその取り扱いを記載しています。
保証の否認
本アプリは、いかなる種類の保証もなく「現状のまま」提供されます。当方は、本アプリが中断しないこと、エラーがないこと、安全であること、または特定の目的に適合することを保証しません。法律で認められる最大限の範囲において、Spencer Poisseroux は、本アプリの利用に起因する間接的・付随的・結果的な損害について責任を負いません。
終了
本アプリの利用はいつでもおやめいただけます。あなたが本規約または適用される法律に違反した場合、当方はアクセスを停止または削除することがあります。終了後も、購入、保証の否認、責任に関する各条項は引き続き有効です。
変更
本規約を重要な点で変更する場合は、「最終更新日」を更新し、次回起動時にアプリ内でお知らせします。お知らせ後も利用を継続した場合は、変更に同意したものとみなされます。
準拠法
本規約は、抵触法の原則にかかわらず、米国ペンシルベニア州の法律に準拠します。
